Influencer Ate Free and Never Posted? Fix the Agreement Before the Visit

If an influencer ate free and never posted, use a calm recovery plan now and put deliverables, payment, rights, and deadlines in writing next time.

If an influencer ate free and never posted, do not invent a charge, threaten them, or claim their content as yours after the fact. Send one calm recovery message based on whatever was actually agreed, then prevent the next miss by defining the food credit, deliverables, deadline, files, disclosure, license, and payment triggers in writing before anyone books.

Those written requirements belong inside a complete restaurant influencer marketing program, not in a panicked message after the meal.

First, follow up on what was actually agreed

Your recovery starts with the records you have, not the outcome you wish had been written down. Save the accepted offer, booking confirmation, visit record, messages, submitted files, and any exception the influencer reported.

If a deadline in the accepted terms has passed, send this:

Hi [NAME], thanks again for visiting [RESTAURANT]. Our accepted terms list [DELIVERABLE] due [ORIGINAL DEADLINE]. We have [RECEIVED ITEMS] and are still missing [MISSING ITEMS]. Can you send them by [PROPOSED RECOVERY DEADLINE], or reply today with the issue so we can agree on a fair next step?

If there was no written deliverable or deadline, say so plainly and ask rather than accuse:

Hi [NAME], I’m following up on your visit to [RESTAURANT]. I do not have a written delivery date in our messages. Are you still planning to send or publish [ITEM]? Please reply with the date you can commit to or let me know that you cannot complete it.

If the influencer reports a real exception, write the revised deliverable, date, payment, and cancellation outcome and have both sides accept it. If the deliverable remains outstanding, mark the collaboration incomplete. Do not pay cash or an ad-use bonus whose written trigger was not met, but do not claw back an already used food credit, charge a card, claim the influencer’s files, or threaten public retaliation unless qualified counsel confirms a remedy under the actual agreement and applicable law.

Keep the missing deliverable as a vendor-performance record, not a review campaign. Do not offer or withhold something in exchange for a positive public review.

Prevent the next missed post with a written agreement

A food influencer collaboration is complete only when every deliverable and payment condition in the accepted agreement has been fulfilled. A booking, a completed meal, a submitted file, and a live post are different events.

Copy this into your offer and fill every bracket before sending it:

Restaurant and location: [RESTAURANT, LOCATION] Influencer: [NAME OR ACCOUNT] Visit: [DATE, ARRIVAL WINDOW, PARTY SIZE] Food credit: [AMOUNT OR INCLUDED ITEMS]; [WHO COVERS OVERAGE, TAX, AND TIP] Cash compensation, if any: [AMOUNT], paid when [EXACT TRIGGER] Required deliverables: [LIVE POST, VIDEO, STORY FRAMES, PHOTOS, OR OTHER AGREED ITEMS] Files to deliver: [RAW OR EDITED FILES, FORMAT, RESOLUTION, TRANSFER METHOD] Deadline: [DATE, TIME, AND TIME ZONE] Disclosure: [EXACT WORDING AND PLACEMENT REVIEWED WITH COUNSEL] Commercial license: [WHO RECEIVES IT, MEDIA, TERRITORY, TERM, EDITING, AND OTHER PERMITTED USES] Partnership-ad permission: [SEPARATE ACCOUNT-LEVEL PERMISSION, IF REQUESTED] Paid-ad-use bonus, if any: [AMOUNT], triggered only when [RESTAURANT] actually runs the content in paid advertising under these terms Reminder plan: [WHEN AND WHERE REMINDERS ARE SENT] Exception path: [CONTACT AND PROCESS FOR ILLNESS, SERVICE FAILURE, CANCELLATION, OR LATE DELIVERY] Completion: [THE EXACT SET OF EVENTS THAT CLOSES THE COLLABORATION] Acceptance: Both sides approve these terms before the visit is booked.

Do not use “one Reel and some Stories” if you expect a file you can download, edit, or run in advertising. Name the live post, each delivered file, and each permission separately.

A posted video, a file, and advertising permission are different things

Agree on each one before the visit. A post going live doesn't give you a downloadable file or permission to advertise from the influencer's account. If you need raw footage, include that in the deliverables too.

The influencer keeps the intellectual property unless a valid agreement says otherwise. A restaurant receives only the license it negotiated, and partnership-ad permission remains a separate approval. Under Remy’s current terms, Remy holds the controlling perpetual license while the influencer keeps the intellectual property; restaurant use remains governed by those terms.

An optional ad-use bonus is not owed because you liked, approved, shortlisted, or planned to run a video. Its trigger is actual paid use under the written terms, while permission to run the partnership ad is a separate step.

Agree on how the food credit will be handled before anyone arrives.

Don't change the food-credit terms at the table

The safest payment order is the one both sides understand before the visit and your staff can execute without improvising. Choose either a food credit applied at the restaurant or a pay-first reimbursement; do not switch the deal at the table.

Option A: Apply the agreed food credit at the visit

The host or manager verifies the approved influencer, applies the stated credit, and records any overage under the written terms. Remy’s documented visit process uses a pass that shows staff the food credit set for that visit.

This is easy on the guest at the table, but the restaurant carries the food cost before the deliverables arrive. Once the meal has been provided, do not assume you can retroactively turn it into a debt or charge a card because the post is late. Any remedy must come from the accepted agreement and advice specific to your situation.

Option B: Use a pay-first reimbursement

Under a pay-first reimbursement, the influencer pays the restaurant check at the visit. The restaurant reimburses the pre-agreed food-credit amount only after the exact completion event named in the accepted terms.

This order avoids handing over the credit before that event, but it adds consequences you have to own: the influencer fronts the money, staff closes a normal check, somebody verifies completion, and you send the reimbursement by the promised method and time. Decide in writing how tax, tip, overage, processing, cancellations, refunds, and a service failure on your side are handled. If your team cannot perform that handoff reliably, use the direct food credit and improve the agreement instead.

Pay-first reimbursement is not a punishment and should never be sprung on the influencer at arrival. It also does not make the restaurant the owner of the content. Run the wording and payment treatment past your counsel and accountant before using it.

Include disclosure in the agreement

The disclosure belongs in the original terms because a comped or discounted meal can be a material connection under the FTC’s Endorsement Guides, even when cash does not change hands.

“The disclosure should be placed with the endorsement message itself.”FTC staff guidance

Specify the wording and placement your counsel approves, then check the live post. FTC staff guidance says disclosures can be missed when buried behind “more,” and a video disclosure should be in the video rather than only its description.

Do not dictate a positive opinion. Your approval test should cover the agreed format, accurate restaurant facts, required disclosure, delivered files, and other objective terms. The FTC’s guidance tells advertisers to give disclosure guidance, monitor what is posted, and take action to address problems; it does not offer a universal safe harbor.

Remind the influencer before the deadline passes

A reminder should remove confusion, not add a new obligation. Schedule it before the visit, after the visit, and before the delivery deadline, with the written agreement linked or attached each time.

Before the visit

Hi [NAME], confirming [DATE/TIME] at [LOCATION]. Your accepted terms list [FOOD-CREDIT METHOD], [DELIVERABLES], and [DEADLINE]. Reply here before [PREVISIT CUTOFF] if anything has changed.

After the visit

Thanks for visiting [RESTAURANT]. We have the visit marked complete. The remaining items are [FILES/POST/DISCLOSURE] by [DEADLINE], sent through [TRANSFER METHOD]. Reply here if you hit a problem.

Before the deadline

Hi [NAME], a reminder that [DELIVERABLES] are due [DATE/TIME/TIME ZONE] under the accepted terms. We have received [ITEMS] and still need [MISSING ITEMS]. Please send them through [TRANSFER METHOD] or reply with the issue.

Do not mistake silence for bad faith. A missed reminder, broken upload link, illness, poor restaurant experience, or unclear brief needs a different response from a refusal to honor accepted terms. The full reminder and exception routine is covered in why an influencer no-show may be a missed reminder.

Save the finished work and settle what you owe

Once the agreed content is delivered, save the files and post link with the usage terms, and make any payment that is due. If an obligation remains unresolved, keep a note of it rather than quietly marking the collaboration complete.

That history will help you decide whom to invite back. A reliable influencer should not be as much work to rebook as someone you have never hosted.

Remy handles the repetitive middle after you set the rules

Remy becomes useful when your written process works but reminders, reschedules, visit follow-up, and file chasing keep falling back on you. Remy platform data records about 25 SMS messages per completed influencer visit, with 94% of those messages occurring after approval; those are coordination events, not employee hours.

The owner still approves influencers, sets the food credit and terms, judges whether files meet the agreement, and handles exceptions. Remy automates the repetitive booking, texting, reminders, and file collection without charging per influencer.

Remy is $300 a month per location: $150 for Remy and $150 for creator recruitment ad spend. Food credits and any agreed influencer payments remain separate.
